What is this Privacy Policy?
ACUM Ltd. – the Association of Composers, Authors and Music Publishers in Israel ("ACUM" or "we") respects the privacy of ACUM members and users of the ACUM website, operated at www.acum.org.il, and at any additional address as may be determined by ACUM at its sole discretion (the "Website").
ACUM is committed to protecting and preserving the privacy of its members and Website users ("you" or the "User").
This Privacy Policy (the "Policy") is intended to inform you regarding the manner in which we manage, collect, store, process and use personal information that you provide to us through the Website or that we collect when you use the Website or its services, including when you register for membership in ACUM.
You should always exercise caution and sound judgment when providing personal information that may identify you or others.
This Policy also explains how you may contact us regarding any matter relating to privacy at ACUM.
This Policy forms an integral part of the Website Terms of Use and is intended to enable you to receive full information before deciding whether to provide personal information to ACUM.
The Policy applies both to users registered for the Website services, including ACUM members, and to users who are not registered, with the necessary changes and equally to all genders. This Policy is drafted in the masculine form solely for convenience, and any reference in the singular shall also include the plural, as the context may require.
Nothing in this Policy derogates from any provision of the ACUM bylaws or from any provision of any license agreement between you and ACUM.
For purposes of this Policy, "Personal Information" means any information or data relating to a person that identifies that person or that can reasonably be used to identify that person, such as full name, address, email address, telephone number, identification number, date of birth, residential address, marital status, payment details and the like.
Providing Details and Personal Information to ACUM
General use of the Website and viewing content published on it do not require registration or the provision of personal information.
However, the Website also includes certain areas and sections that require registration, the submission of details, or the entry of access credentials provided to you in advance, such as sections intended only for ACUM members or the online licensing service.
When registering for services or sections that require registration, we may ask you to provide identifying details and personal information, including full name, an active email address in your possession, telephone number, address, and other personal information, all in accordance with the nature of the relevant service.
For example, when arranging a license for the use of music at a family event, you may be required to provide information about the planned event.
Mandatory fields will be clearly marked. Without providing the requested information in mandatory fields, you will not be able to complete registration for such services.
You may also provide us with additional personal information in correspondence with ACUM representatives, including digital communications, and whenever you enter personal information into any online form on the Website.
Where personal information is required in order to use any of the Website services, you must provide only true, accurate and complete information, and you hereby confirm the accuracy of the information provided.
The personal information you provide will be stored in ACUM's databases.
You are not legally required to provide personal information to ACUM, and providing such information is subject to your consent. However, please note that providing inaccurate information, or failing to provide all requested personal information, may prevent you from using the Website services, impair the quality of the service provided to you, and affect our ability to contact you when necessary.
If your details change, you must update them online through the Website or with the assistance of ACUM representatives.
Where you provide personal information relating to a third party, you represent and confirm that you have obtained that person's explicit consent to provide such information to ACUM for use in accordance with this Policy.
Membership Registration and Membership Management
ACUM is a non-profit organization engaged in the collective management of copyrights and represents thousands of Israeli creators of musical and literary works, including composers, authors, lyricists, arrangers, writers, poets and music publishers.
ACUM engages, on a daily basis, in the protection of copyrights, the granting of licenses for the use of works included in the ACUM repertoire, and the distribution of royalties to creators and corresponding societies.
As a creator, you may apply to join ACUM through the Website and the registration options it offers, as well as through ACUM's Members Department and through additional channels.
In order to provide members with all ACUM services, and in the course of membership registration and membership administration, ACUM may collect and process various categories of personal information concerning membership applicants and members, including: full name; identification number and a copy thereof; bank account details or other means of payment; telephone number and email address; address; date of birth and/or date of death; information regarding wills and inheritances (in the case of deceased members); tax certificates; requests and correspondence concerning membership in ACUM; management of the creator's repertoire; legal advice; forms; agreements; powers of attorney / deeds of assignment / declarations; information concerning royalties and reports regarding use of works; and additional information, as required by the circumstances.
Information We Collect When You Use the Website
When you use the Website, we may collect information regarding your usage patterns, including content you have read, pages you have viewed, search queries you have performed, online services and sections that interested you, frequency of use, the location of your computer, the Internet Protocol (IP) address through which you accessed the Website, the type of operating system used on your device, the type of device you use, and similar information.
ACUM may collect and use the services of third parties in order to collect and analyze anonymous, statistical or aggregated information relating to your details and activities in connection with use of the Website, including through services such as Google Analytics or similar services.
How We Use Personal Information
ACUM may use the personal information you provide and the personal information collected when you use the Website and its services, in accordance with this Policy and any applicable law, for the following purposes:
- To enable you to use the Website, its content, services and various sections, including enabling you to use services provided by ACUM, such as arranging a license for the use of music online, and to allow ACUM to provide you with such services;
- To facilitate and manage your ACUM membership, including managing your requests, payments, correspondence with you, legal protection for members and represented rights holders, and any other service provided by ACUM;
- To identify or verify your identity during repeated access to areas that require registration and, where appropriate, to save you from re-entering your details each time;
- To improve and enrich the services and content on the Website, including by creating new services and content suited to users' requirements and expectations, and by changing or discontinuing existing services and content; for these purposes, the information used will generally be statistical in nature and will not personally identify you;
- To improve the quality of information maintained in ACUM's databases;
- To tailor Website services to your preferences;
- To send you, from time to time, information regarding Website services and content, ACUM services and activities, advertisements, direct marketing messages, surveys, newsletters and the like. Such information may be promotional in nature and may be sent to you in writing, by SMS, by email or by other electronic means, as further detailed in the Website Terms of Use;
- To contact you where ACUM believes that there is a need to do so;
- To enforce the provisions of binding documents, comply with any law, regulation or other legal requirement, and assist competent authorities and any third party where ACUM believes in good faith that it is required to do so;
- For the proper operation and development of the Website and its services, including support and service; and
- For any other purpose specified in this Policy or in any binding document.
Disclosure of Personal Information
Except as described in this Policy, the personal information you provide to ACUM or that ACUM collects will not be sold, transferred or shared with third parties without your consent, except in the following circumstances:
- Where necessary for the proper provision of Website services or ACUM services, including membership services, we may share personal information with third parties acting on our behalf, assisting in the operation of the Website, serving as ACUM suppliers, or assisting in the provision of services to you. Such third parties may use and process your personal information only to the extent necessary for the performance of the services they provide to ACUM, in accordance with our instructions, and they are required to implement appropriate information security measures in order to protect and maintain the confidentiality of your personal information. These third parties may include service providers and advisors, such as lawyers, accountants, internal auditors and the like;
- As a member, limited information about you and works in your repertoire may be displayed in ACUM's public database, and ACUM may also transfer such information to international works databases. Such information will generally include only your name and your works, without additional personal information;
- If you breach the provisions of any binding document, or if you carry out through the Website, or in connection with it, actions that ACUM deems to be contrary to law, or any attempt to carry out such actions;
- If ACUM receives a judicial order, or a lawful demand from a competent authority, requiring it to disclose your details or personal information relating to you to a third party or the relevant authority;
- In connection with any dispute, claim, demand or legal proceeding, if any, between you and ACUM or anyone acting on its behalf;
- In any case where ACUM believes that disclosure of the information is necessary in order to prevent serious harm to your person or property, or to the person or property of a third party;
- As a creator, in order to enable us to connect you with other ACUM members or additional parties for collaboration purposes, you may expressly authorize us to provide your contact details (your email address and telephone number) to such parties. Without your approval, your details will not be disclosed under this subsection;
- ACUM may transfer your details and collected personal information to affiliated companies or organizations related to ACUM, such as a parent company, subsidiary or sister company, provided that such entities use the information only in accordance with this Policy;
- ACUM may disclose and share anonymous, aggregated and statistical information with companies or organizations related to ACUM, as well as with suppliers, business partners, advertisers and other third parties, provided that ACUM does not knowingly disclose personal information that identifies you without your consent;
- If ACUM organizes its activities or the Website within another framework, changes its legal structure, merges with another entity, or merges the activity of the Website with the activity of a third party, ACUM shall be entitled to transfer to the new entity a copy of the personal information about you contained in ACUM's databases, provided that such entity undertakes to comply with the provisions of this Policy; or
- Upon your explicit request.

We use cookies on the Website for its proper and ongoing operation, to avoid the need to re-enter your username and password each time you revisit sections that require registration, and in order to collect statistical data regarding use of the Website, verify details, tailor the Website to your personal preferences, support marketing needs and maintain information security.

Where Is Information Stored?
Information collected by ACUM is stored in ACUM's databases, which are hosted by server hosting and information backup providers. Additional information, as described in this Policy, may be collected and stored by other companies as well, such as analytics providers. Such databases and providers may also be located outside the borders of Israel. Your consent to this Policy also constitutes consent to the storage and transfer of information outside Israel.
Information Security
ACUM attributes great importance to information security and implements systems and procedures intended to minimize the risks of theft, damage, loss or unauthorized access to information, including personal information. However, there is no certainty that such measures can absolutely guarantee that personal information will not be exposed to unauthorized access or stolen from databases. Accordingly, ACUM does not undertake, and you cannot reasonably expect, that the services and information systems used by ACUM will be immune from unauthorized access to the information stored therein. By using the Website and its services, you acknowledge and agree to these limitations.
Social Networks
ACUM may make available to Website users tools for sharing and linking Website content through social networks and various online services, and we may also refer Website users to ACUM social media channels, such as pages operated by ACUM on Facebook, YouTube, Instagram and others.
Please note that the use of such social networks and online services is external to and separate from the Website, and is subject to the privacy practices and policies of those services. This Policy does not apply to the activities of those social networks or any other online service operated by a third party.
Right to Review and Correct Information
Under the Israeli Protection of Privacy Law, 1981, every person is entitled to review, personally or through an authorized representative or guardian, information relating to that person that is held in a database.
A person who reviews information concerning him or her and finds that it is incorrect, incomplete, unclear or outdated may apply to the owner of the database to correct or delete the information. If the database owner refuses, it must notify the applicant in the manner prescribed by the regulations enacted under the Protection of Privacy Law. A person whose request has been denied may appeal such refusal in the manner prescribed in those regulations.
In addition, where information in ACUM's databases is used for direct mailing based on your belonging to a population group determined according to one or more characteristics of persons whose names are included in the database, you are entitled under the Protection of Privacy Law to request in writing that the information relating to you be deleted from the database. In such case, ACUM will delete information required only for making direct marketing approaches to you.
Please note that deletion of information may prevent you from continuing to receive services from the Website or may lead to cancellation of your registration for certain sections of the Website. Information required by ACUM for the management of its business, including records of actions you performed on the Website or in your personal area, will continue to be retained by ACUM as required by law, but will no longer be used for direct marketing purposes. If, within 30 days, you do not receive notice that the information ACUM was requested to delete has indeed been deleted under this section, you will be entitled to apply to the competent court in the manner prescribed by the regulations issued under the Protection of Privacy Law, in order to instruct ACUM to act accordingly.
Children's Privacy
ACUM is committed to protecting the privacy of Website users in general, and in particular the privacy of minors. We recommend that parents and legal guardians take an active role in their children's activities on the Internet.
ACUM does not knowingly collect personal information from minors under the age of 18 without the consent of a parent or legal guardian to the collection and use of such information in connection with services provided by ACUM or any activity or service made available through the Website.
Changes to the Privacy Policy
ACUM may amend this Privacy Policy from time to time. If we make material changes to this Policy, including changes relating to the use of the personal information you provided, we will publish notice of such changes on the Website or notify you using the contact details you provided, as applicable. If we make such changes pursuant to the provisions of law, or the requirement of a competent authority, such changes shall take effect in accordance with the relevant legal requirements or such requirement. We recommend that you review this Privacy Policy from time to time.
